Asters participated in the UBA's III Forum on Family and Inheritance Law

Asters contributed to the organisation and hosting of the III Forum on Family and Inheritance Law of the Ukrainian Bar Association (UBA). The event brought together leading experts in civil, family and inheritance law, representatives of relevant state and regulatory institutions, and judges to discuss key aspects of family law.

Asters lawyers participated in the forum's panel sessions.

Partner and Head of Family & Inheritance Law Practice Talina Kravtsova moderated the session "Child Rights Protection". She emphasised the importance of the topic, particularly in the context of the war, and noted that the most common threats to children's rights are domestic violence, psychological pressure, non-payment of alimony, parental indifference, and general instability, all of which increase children's vulnerability. During the session, the speakers also discussed the following:

  • the specifics of enforcement of alimony abroad
  • court consideration of issues related to the protection of children from domestic violence
  • national practice in implementing Article 12 of the Convention on the Rights of the Child
  • strengthening the protection of children’s rights through amendments to family legislation

Practice Counsel Yuriy Neklyaev moderated a discussion on inheritance and estate planning. The speakers discussed the following topics:

  • testament as a tool for the effective distribution of property and business
  • Inheritance under martial law through the prism of compensation procedures
  • trends in court practice in inheritance disputes

Partner and Head of Tax Practice at Asters Kostyantyn Solyar joined the discussion and presented the tax aspects of estate planning. He explained the legal nature of trusts in Anglo-Saxon jurisdictions, provided examples of their practical use, and outlined the relevant tax nuances.

Asters' Associate Maryna Korniienko spoke at the session "International Aspects of Family Law: Current Challenges" and discussed the specifics of dividing marital property acquired abroad. She highlighted the key aspects of such cases: determining the applicable law and jurisdiction in disputes over the division of foreign property; procedures for the recognition and enforcement of court decisions between different states; and the regulation of the property regime of assets in accordance with foreign legislation.
