Oksana Legka spoke at London event on cross-border enforcement of arbitral awards

Asters' Partner Oksana Legka spoke at the event "Cross-border enforcement of arbitral awards: legal and practical challenges" organised on 29 September 2025 by Kennedys, Asters, Sayenko Kharenko, UNBA, UNITA and the Association of Private Enforcement Officers of Ukraine in London.

The event brought together international speakers from the UK, USA, France and Ukraine to discuss recognition, enforcement and execution of arbitral awards with a focus on Ukraine, including:

  • enforcement challenges across key jurisdictions
  • strategies in unstable regions and the impact of the war in Ukraine
  • public policy issues, asset securing tools, state immunity
  • asset tracing
  • cross-border collaboration and coordination of enforcement efforts
  • challenges with digital assets
  • impact of sanctions.

During her speech, Oksana Legka highlighted recent trends in Ukrainian jurisprudence as regards the situations when public policy exception is applied that includes instances of the recognition and enforcement of arbitral awards rendered against Ukrainian state-owned enterprises in a defence sector and when the party seeking the enforcement is subject to sanctions. Oksana has explained how the balance is reached in Ukrainian courts between the protection of national interests amidst the realities of the ongoing war and obligations of the state being bound by international treaties.
