
Asters has successfully represented Teva Ukraine in proceedings before the Antimonopoly Committee of Ukraine (AMCU) concerning alleged violations of competition law.
The AMCU investigated whether Teva Ukraine’s system of retrospective discounts on pharmaceutical products restricted competition or contributed to price increases.
Throughout the proceedings, Asters’ team collected extensive analytical data, market studies, and other supporting evidence to demonstrate that the company’s discount mechanism had no anti-competitive effect. Instead, it fostered competition and helped reduce prices across the distribution chain.
This case was part of a broader series of high-profile investigations launched by the AMCU in 2013–2014 into the use of retrospective discounts and bonuses by international pharmaceutical companies. Teva Ukraine’s case was the only one ultimately closed due to a lack of evidence of any violation.
