Asters successfully defends MHP in AMC merger case

Asters acted for MHP, Europe’s largest poultry producer, in proceedings before the Antimonopoly Committee of Ukraine (AMC), which after nearly four years of investigation, closed the gun-jumping case without finding any violations.

The investigation concerned allegations that MHP acquired control over Ukrainian meat producer Skott Smeat without merger clearance. The case is notable for testing, among others, the nuances of geographic allocation of turnover under Ukrainian merger control rules. The AMC’s decision to close the case reinforces legal certainty and proportionality, while supporting Ukraine’s alignment with the EU acquis.
