The Government defines minerals and subsoil resources to be granted for use through auctions for special permits or production sharing agreements

On 14 July 2025, the Cabinet of Ministers of Ukraine adopted Resolution No. 845, which approved the list of minerals of strategic and critical importance, as well as the lists of subsoil plots to be granted for use either through auctions for the sale of special permits for subsoil use or through competitive tenders for the conclusion of production sharing agreements ("PSA").

The Resolution was adopted in implementation of the Subsoil Code of Ukraine and represents a continuation of measures in the field of critical raw materials management, as envisaged in Section 13 of Ukraine’s Plan under the Ukraine Facility.

In the Resolution, the Cabinet of Ministers of Ukraine classified minerals into two categories:

  1. Minerals of strategic importance – metallic ores and non-metallic minerals of nationwide significance that are of strategic importance for domestic industries ensuring sustainable economic development and the state's defense capability, and the supply of which on the global market is or may potentially be significantly disrupted compared to projected demand.
  2. Minerals of critical importance – strategic or other minerals that are essential for the economy and defense capability, have no substitutes at the current level of technology, and are subject to a high risk of supply disruptions to Ukraine.

The Resolution also approved the list of subsoil plots of strategic and/or critical importance to be granted for use through auctions for the sale of special permits for subsoil use.

A separate list of subsoil plots has been defined to be granted for use through competitive tenders for the conclusion of PSAs.
