The international law firm of Herbert Smith with assistance from Asters held an international Dispute Resolution Seminar at Hyatt Regency Hotel in Kyiv on 24 March 2011. The seminar addressed resolution of disputes involving Ukrainian parties outside the framework of the Ukrainian courts with particular focus on enforcement options and the need for strategic considerations and aggressive counter-measures to 'guerrilla tactics'. It was attended by over 60 law practitioners from international and Ukrainian law firms, companies and professional media.
Chaired by Herbert Smith partners Simon Bushell and Matthew Weiniger from London, the seminar was based on a case study to draw out a variety of issues, including potential claims, limitations, arbitration options, interim measures and enforcement. The case and its impact for contracting parties were intensively discussed in this good response seminar from a comparative and international perspective. Speakers Oleksiy Didkovskiy from Asters, Iryna Nazarova from EnGarde, Dmytro Marchukov from Magisters and Oleksiy Filatov from Vasil Kisil & Partners carefully considered Ukrainian law issues related to the case. In addition, Nicos Georgiades from Georgiades & Pelides LLC and Dr. Erhard Böhm from Baier Böhm Attorneys at Law provided insights from a Cypriot and Austrian law perspective respectively. Group discussions of the case study to exchange views on the topic were organized as part of the seminar.
