Asters defends interests of Bayer Ukraine before AMC

Asters successfully defended interests of Bayer Ukraine, a leading international healthcare and agriculture company, before the Antimonopoly Committee of Ukraine (AMC).

On 26 July 2019, the AMC closed proceedings in the case on the alleged violation of the competition law by Bayer LLC, as the company complied with the AMC's recommendations concerning revision of certain provisions of distribution agreements.

'This is the first of a series of the AMC's investigations against pharma businesses that did not end in finding a violation and a fine. We are delighted with this outcome. We are also grateful to the AMC for detailed examination of differences between the distribution model of Bayer Ukraine and the ones used by other big pharma businesses, as well as for concluding that no significant harm to the competition was caused and that certain amendments to the agreements would alleviate any concerns,' Asters partner Igor Svechkar has commented on the positive outcome of the case.
