Asters defended PrivatBank in the Supreme Court, which did not allow the former owner to cancel loan agreements with the NBU

Asters successfully defended the interests of PrivatBank in the Supreme Court, which on 7 April 2023 dismissed the claim of the bank’s former owner Mr. Kolomoisky to invalidate five refinancing loans and five personal guarantee agreements of Mr. Kolomoisky.

With its decision, the Supreme Court put an end to the case that began in May 2019, when Mr. Kolomoisky filed five similar claims against PrivatBank and the National Bank of Ukraine (NBU) with the Kyiv Commercial Court. In June 2020, the Court granted his claim in full, despite the fact that as at the time of the decision, PrivatBank had fully repaid the loans to the NBU. In August 2022, the Northern Commercial Court of Appeal upheld the decision of the previous instance.
