Amendments to the procedure for reservation of conscripts entered into force

On 16 January 2024, the Cabinet of Ministers of Ukraine amended Resolution No.76, which defines the procedure to reserve conscripts and establishes criteria to determine enterprises as critical to the functioning of the economy. Asters' Counsels Yuna Potomkina and Anton Sintsov were involved as experts in the preparation of the amendments.

The amendments refer to enterprises identified by the Ministry of Strategic Industries of Ukraine as critical to the defence industry and allow them to apply for reservation without restrictions on the number of conscripts, as well as to reserve conscripts regardless of their military rank, age and military speciality.

The relevant amendments entered into force on 19 January 2024.

Notably, the Order of the Ministry of Strategic Industries of Ukraine No.27 as of 23 February 2023 approved the Criteria for the Ministry of Strategic Industries of Ukraine to determine enterprises, institutions and organisations in the defence industry, manufacturing, aircraft industry and space activities as being of importance to the national economy.
