Tetiana Popovska spoke at the XI UBA Criminal and Procedure Law Conference

Asters' Associate Tetiana Popovska spoke at the XI Criminal and Procedure Law Conference organised on 15 November 2024 by the Ukrainian Bar Association (UBA). She joined the session on trends in criminal law and spoke about agreements in cases of corruption-related criminal offenses.

Tetiana Popovska noted that for a long time this issue has been discussed by the media, lawyers and public. On 1 November 2024 the Law on Agreements in corruption cases entered into force. The speaker presented the main conditions and grounds for concluding such agreements, amendments to the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine in view of the Law, and also focused on certain problematic issues and risks that may arise when concluding agreements with corrupt officials.

The event brought together legal practitioners, academics, prosecutors, judges and government officials to discuss topical issues in this area, namely:

  • the new Criminal Code, key changes and their impact on law enforcement practice
  • ratification of the Rome Statute, activation of anti-corruption bodies (NABU/HACC)
  • court practice, forensic examination in WCC proceedings
  • seizure and cancellation of cryptocurrency seizure
  • reasonable amount of bail and overview of the situation with the application of bail in criminal cases
  • terms of pre-trial investigation, terms in factual proceedings and closure of criminal proceedings within a reasonable time with the help of an investigating judge
  • criminal proceedings with an international element
