Asters as the General Sponsor of the Competition Forum of Ukraine


Asters played a role of the General Sponsor of the Competition Forum of Ukraine held on 15-16 October 2009 in Kyiv and arranged with support of the Antimonopoly Committee of Ukraine (AMCU).

The Forum, called to discuss among professionals the philosophy of competition being a moving force of the economy, other relevant subjects, and to define prospects for the development of antimonopoly practices in Ukraine, presented to the participants the latest AMCU developments.

The Forum offered a unique opportunity for an open dialogue between the AMCU and the competition lawyers in discussing problematic topics, including cartels and abuses of the monopoly positions on business markets, liability for unfair competition practices, misleading advertizing, concentration, and anticompetitive practices by governmental authorities.

The two-day event brought together over 70 participants, including the top management of corporations, public institutions, and law firms, as well as managers and experts of the legal departments, scientists, private counsels, and the media. Representing Asters, partners Oleksandr Padalka and Igor Svechkar and associate Tetyana Vovk actively participated in the debates at the Forum.

Igor Svechkar, head of the antimonopoly practice group, head of the UBA competition law committee, made a presentation entitled "Three phases control over concentration: filing, AMCU review, and closing", which focused on cross-boarder and Ukrainian transaction closing issues, liabilities incurred for late closing, etc.

The presentation given by Oleksandr Padalka dealt with arguing and proving intellectual property rights infringements in the cases of illegal use of trade marks. It later unwound into a discussion with the AMCU participants regarding the existing deficiencies in Ukrainian IPO laws, which lawyers come across when defending their clients in unfair competition proceedings. Further, the participants discussed possible practicable approaches how to resolve the issues.

Tetyana Vovk expressed her view of the differences between the regulation of economic concentration in Ukraine and the EU and emphasized that certain legislative amendments are needed to improve such regulation in Ukraine.
